If the husband accepts Islam, but the woman is a Magian who then accepts Islam after him, they can continue as husband and wife. Still, if she does not accept Islam immediately, they are separated. Separate in Peace:
They may separate in peace, and each of them may seek fulfillment with somebody else in a new marriage. Marriage is thus to be understood simply as a contract and should be made to work as long as love and respect for each other last. Islam aims to establish a healthy family unit through marriage. Still, if this purpose fails, there is no need to linger under pretenses, as is the practice among adherents of some other religions where the procedure of divorce in Pakistan is theoretically not permitted. A vow is taken in the marriage ceremony that they will not separate until death does us part. It is unacceptable to leave one’s wife hanging in mid-air, and if there remains no chance for reconciliation, then the procedure of divorce in Pakistan is the last resort.
Divorce in Islam:
Divorce in Islam only permits one to divorce one’s wife or wife under certain conditions. First, Muslims can only divorce their wives once, and then there is the iddah consisting of three distinct and separate menstrual periods within which time they may endeavor to become reconciled. Still, should all attempts at reconciliation prove unsuccessful, then in the third menstrual period, the final separation becomes effective.
Divorce may be given orally or in writing, and it does not need to occur in the presence of witnesses. Whatever the actual words used for divorce, they must expressly convey that the marriage tie is being dissolved.
Divorce Procedure in Pakistan:
As to whether a procedure of divorce in Pakistan would be effective under certain circumstances, there are differences between the schools. The intention is as necessary a factor in the dissolution of marriage as in the marriage itself, but while some recognize that divorce is ineffective if given under compulsion, or in a state of intoxication, or anger or jest, or by mistake or inadvertently, others hold it to be ineffective in some of these cases and effective in others. The Hanafi school’s view is that the divorce becomes effective whether the words are uttered in sport or jest or a state of drunkenness and whether a person utters them willingly or under compulsion. Still, Imam Shafi, for example, says that divorce in such circumstances does not become effective.
